    “Applicable Law” means all applicable European Union legislation and all applicable legislation of the Republic of Estonia, including, but not limited to, the national implementing acts of the IKÜM, which are in force during the validity of these terms and conditions or come into force after the terms and conditions are established;
    “User”means any person who uses our Site;
    “Portal” or “we” means ImmoRapid OÜ, registry code 17150270, address Järve tn. 2, Tallinn Harjumaa 11314 Estonia;
    “Site” means the Immo Rapid website at immorapid.pl and its subdomains, including its software, hardware, databases, interfaces, linked pages, documentation, updates and other connected or merged components and materials;
    “Data Protection Terms”means this personal data processing document;
    “Services” means all services on the Site (including, but not limited to, the purchase/sale/rent/lease/bidding of goods and/or services)
    “Controller” means a natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of Personal Data. For the purposes of these Terms and Conditions, the Controller of Personal Data is the Portal;
    “Authorised Processor” means a natural or legal person, public authority, agency or other body which processes Personal Data on behalf of the Controller.
  2. PURPOSES OF PROCESSING PERSONAL DATA

    As the Controller, we process Personal Data for the purposes set out in these data protection terms. We base our processing of Personal Data on the Applicable Law, including the Personal Data Protection Act and other legislation governing the processing of Personal Data.

    We base our processing of Personal Data on the principles of Personal Data protection, including the principle of minimization, according to which we process only the data that is necessary to provide the Services and fulfill the purposes.

    We process Personal Data only on the grounds provided by law. In this case, our legal basis for processing Personal Data is your consent, fulfillment of a contractual obligation, fulfillment of a legal obligation and/or legitimate interest:

    • Processing Personal Data on the basis of consent In cases where you have given us separate consent to process your Personal Data, the legal basis for processing your Personal Data is your consent. In such cases, we process your Personal Data only for the purposes specified in the consent and to the extent specified in the consent. Please note that if you have given us your consent to process your Personal Data, you have the right to withdraw your consent at any time. The legal basis for processing personal data in such cases is Article 6(1)(a) of the GDPR. For example, we process data related to sending newsletters on the basis of consent.     • Processing of personal data for purposes related to the performance of a contract We process Personal Data primarily for the provision of services and the performance of contractual obligations. The legal basis for processing Personal Data for the provision of services is Article 6(1)(b) of the GDPR (the processing of personal data is necessary for the performance of a contract concluded with the participation of the Data Subject or for taking measures prior to entering into a contract at the request of the Data Subject).
    • Processing of personal data for the performance of a legal obligation We process personal data when it is necessary for the performance of legal obligations to which it is subject. For example, if we are required by a court to provide Personal Data pursuant to a valid court order or judgment, or if Personal Data is required by a law enforcement agency pursuant to a valid regulation. Also, if we are obliged to retain Personal Data, for example, pursuant to the Accounting Act or other applicable legislation. The legal basis for processing Personal Data in such processing is Article 6(1)(c) of the GDPR (the processing of Personal Data is necessary for the performance of a legal obligation of the controller).
    • Processing Personal Data Based on Legitimate InterestIn certain cases, we may also process Personal Data if this is necessary for our legitimate interest. In such a case, the legal basis for processing Personal Data is Article 6(1)(f) of the GDPR. We process Personal Data on the basis of a legitimate interest only if such processing is not overridden by the interests or fundamental rights and freedoms of the Data Subject, for which the Personal Data must be protected. Only data obtained from the Data Subject or arising in the course of performance of a contract are processed on the basis of a legitimate interest. We may have a legitimate interest in processing Personal Data if this is necessary for the establishment, exercise or defence of legal claims. For example, such a need may arise in a situation where the Data Subject has breached the contract. For example, in a situation where the User has used the Site for illegal transactions. The retention of data processed on the basis of legitimate interest is based on the statutory term, which is 3 years after the provision of the service.   4. TRANSFER OF PERSONAL DATA AND AUTHORIZED PROCESSORS

    1. We do not transfer Personal Data to third parties, except when legally entitled to do so under Applicable Law. We also do not transfer Personal Data outside the European Union.
    2. We may use Authorized Processors to process Personal Data. Authorized Processors appointed by us, who may process Personal Data in limited cases, are, for example, various service providers necessary for the company's business or other services required for the functioning of the Site (for example, accounting-related companies, debt collection companies, etc.). Also other companies belonging to the ImmoRapid OÜ.
    3. We use trusted cooperation partners as authorized processors, who process personal data in accordance with the law and the contract concluded with us and the instructions prepared by us.
    4. The Immo Rapid portal has the right to transfer personal data published by the user in the advertisement (including name, contact details, data related to the item/object) to the provider of services integrated with the services offered (such as sales and auction environments) with the aim of promoting the sale of the item presented in the advertisement and facilitating the receipt of additional offers, including transferring personal data to third parties for the purpose of providing a map application reflecting the content of the advertisements on a third party's website.
  5. RIGHTS OF THE DATA SUBJECT

    5. right to object: the right to object to the processing of your Personal Data by us, for example when the use of the Personal Data is based on our legitimate interest;
    6. right to request erasure of Personal Data: the right to request the erasure of Personal Data, for example when the Personal Data is processed with the consent of the Data Subject and the Data Subject has withdrawn the consent;
    7. right to restriction of processing: the right to request that we restrict the processing of Personal Data on the basis of applicable law, for example when we no longer need the Personal Data to achieve the purposes of the processing or when the Data Subject has objected to the processing of Personal Data;
    8. right to withdraw consent to the processing of Personal Data: where the processing of Personal Data is based on the consent given by the Data Subject, the Data Subject has the right to withdraw the consent given to us at any time;
    9. right to data portability: the right to receive from us Personal Data that the Data Subject has provided to us and which are processed on the basis of the Data Subject’s consent or for the performance of a contract concluded with the Data Subject in writing or in a commonly used electronic format and, where technically feasible, to request that we transmit those data to another controller;
    10. right to lodge a complaint: If the Data Subject considers that his/her rights have been violated in the processing of his/her Personal Data, he/she always has the right to lodge a claim or complaint with the Data Protection Inspectorate – Tatari 39, 10134 Tallinn, info@aki.ee, www.aki.ee.
    11. The rights of the Data Subject listed in this section in relation to the processing of his/her Personal Data are not exhaustive. In certain cases, the rights of other Data Subjects or our legal obligations may limit the rights of the Data Subject.

  6. SECURITY OF PERSONAL DATA

    1. We undertake to ensure the security of the processing of Personal Data, with the aim of protecting Personal Data against accidental or unauthorized processing, disclosure or destruction.

Taking into account the latest developments in science and technology and the costs of implementation, the nature, scope, context and purposes of the processing of Personal Data, as well as the risks of varying likelihood and magnitude to the rights and freedoms of Data Subjects arising from the processing, we implement appropriate technical and organizational measures to ensure the security of Personal Data when processing Personal Data.
